What kind of legal sentence will a CDL truck driver get if involved in an accident which results in death? What if marijuana is found in his/her system?
The primary unanswered questions are what state is involved and what charge is levied. A true “accident” is not a crime at all. Violating some law and thereby causing the death of another is quite different. If you were in my state and a jury determined that you were driving while under the influence of marijuana and caused the death of another, the sentence would be at least two years and perhaps as much as twenty years.
Just being involved in an accident is not illegal. If it is truly an accident, or the truck driver was not at fault, nothing should happen to him. If he is found to be at fault for the accident, he could be charged with anything from vehicular homicide to involuntary manslaughter, depending on what he actually did to cause the accident.
If marijuana is found in his system, again, it depends on many variables. One thing for certain: he will have a drug test no matter if he was at fault for the accident or not, or if he gets charged with a crime or not. And if the test finds drugs in his system, he will lose his CDL, which would also result in him losing his job.
